General Terms and Conditions

  1. Scope These General Terms and Conditions (GTC) apply to all deliveries made by Uta Schmidt (hereinafter referred to as “Dream Chasers”) to consumers. A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly neither be attributed to their commercial nor their independent professional activity.
  2. Contractual Partner The purchase contract is concluded with Dream Chasers, represented by Uta Schmidt, Bachstraße 30, 69221 Dossenheim, Germany.
  3. Conclusion of the Contract
    • The presentation of products in the online shop does not constitute a legally binding offer, but merely an invitation to place an order.
    • By clicking the button [Buy/order with obligation to pay], you make a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order through an order confirmation email immediately after receipt of your order.
  4. Right of Withdrawal
    • If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a statutory right of withdrawal.
    • If you exercise your right of withdrawal according to section 4.1, you must bear the regular costs of returning the goods.
    • Furthermore, the regulations regarding the right of withdrawal, which are detailed below, apply.

    Right of Withdrawal

    You have the right to withdraw from this contract within fourteen days without giving any reason.

    The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

    To exercise your right of withdrawal, you must inform us [Dream Chasers – Bachstraße 30, 69221 Dossenheim, Germany] by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory. You can also complete and submit the model withdrawal form or any other clear statement electronically via our website https://dream-chasers.de. If you make use of this option, we will send you an immediate confirmation of receipt of such a withdrawal (e.g., by email at usmdca777@gmail.com).

    To meet the withdrawal deadline, it is sufficient for you to send the notification concerning your exercise of the right of withdrawal before the withdrawal period has expired.

    Consequences of Withdrawal

    If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for the additional costs arising from your choosing a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the initial transaction unless expressly agreed otherwise with you; in no case will you be charged for this repayment. We may withhold the reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

    You must return the goods immediately and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract to us or to (insert the name and address of the person authorized by you to receive the goods, if applicable). The deadline is met if you send back the goods before the period of fourteen days has expired.

    You bear the direct cost of returning the goods.

    You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

  5. Prices and Shipping Costs
    • The prices listed on the product pages include statutory VAT and other price components.
    • In addition to the stated prices, we charge a flat rate of €6.90 per order for delivery within Germany. The shipping costs will be clearly communicated to you again on the product pages, in the shopping cart system, and on the order page.
    • For payment by cash on delivery, an additional fee of €2 will be due, which will be collected by the delivery agent on-site. No additional taxes or costs are incurred.
  6. Delivery
    • Delivery is only available within Germany via DHL.
    • The delivery time is up to 3 days. Any deviations in delivery time will be indicated on the respective product page.
  7. Payment
    • Payment can be made either by prepayment or cash on delivery.
    • If you select the prepayment method, we will provide you with our bank details in the order confirmation, and the goods will be delivered upon receipt of payment.
  8. Retention of Title
    • The goods remain our property until full payment has been made.
  9. Dispute Resolution
    • The EU Commission has created an internet platform for online dispute resolution. This platform serves as a contact point for the extrajudicial resolution of disputes concerning contractual obligations arising from online purchase contracts. More information is available under the following link: http://ec.europa.eu/consumers/odr. We are willing to participate in a dispute resolution procedure before a consumer arbitration board, or we are obliged to do so according to XXX (provide legal regulation or contractual agreement). The responsible consumer arbitration board is: General Arbitration Board of the Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure before this body for the resolution of the aforementioned disputes.

    Alternatively: The EU Commission has created an internet platform for online dispute resolution. This platform serves as a contact point for the extrajudicial resolution of disputes concerning contractual obligations arising from online purchase contracts. More information is available under the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
